The US Court of Appeals, Seventh Circuit, ruled recently that a worker on a Mississippi barge can legally file a retaliatory firing lawsuit. The worker was fired after he repeatedly complained to management about his co-workers’ drug use. The court’s ruling took into consideration the tension and potential conflict between admiralty law and the importance of safety. The court said that the allegations do not fall under the jurisdiction of the federal Seaman’s Protection Act because there was no evidence that the worker intended to report the drug use to the U.S. Coast Guard.
