Admiralty Law Questions Arise Over Shark Tourist’s Death

Questions over the jurisdiction of federal admiralty law have arisen after the February 24 death of Markus Groh, an Austrian attorney, who was bitten on the leg during a shark tourism dive in the Bahamas. The question at hand is whether Groh’s family is entitled to file a negligence lawsuit against the tour operator for failing to ensure the safety of its customers.

Under Florida law, a waiver signed by Groh before embarking on the dive may bar his family from claiming any damages. If federal admiralty law applies, however, the waiver may not be a factor.
